These Terms of Service (“Terms”) govern your use of the 3mpwrApp mobile application and website (collectively, the “Service”) provided by 3mpwrApp (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Service, you confirm that you are at least 13 years of age (or the minimum legal age in your jurisdiction) and that you accept these Terms in full. If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

3mpwrApp is a free community tool designed for injured workers, persons with disabilities, and their allies in Canada and the United States. The Service provides:

🏠 Local-first advocacy tools — symptom, mood, medication, appointment, activity, and energy trackers
📂 Evidence Locker — secure on-device storage for case documentation
⚖️ Appeal Command Center — legal deadline and timeline management
🤝 Community features — peer support, advocacy campaigns, and resource sharing
🔒 Privacy-by-design architecture — 100% user data ownership

The Service is provided “as is” and “as available” for personal, non-commercial use.

3. 100% User Data Ownership

Consistent with our Data Ownership Statement, all data you create in 3mpwrApp belongs entirely to you.

We do not own, claim, or retain your personal information
Data stays on your device by default unless you choose to sync to your own cloud
No data passes through our servers without your explicit action
You may export or delete your data at any time

4. User Responsibilities

You agree to:

Provide accurate information where you choose to create an account
Use the Service lawfully and only for its intended purpose
Respect other community members per our Community Guidelines
Not upload unlawful, harmful, or rights-infringing content
Not attempt to reverse-engineer, disrupt, or misuse the Service

No Medical or Legal Advice: The Service provides organizational and informational tools only. It does not constitute medical, legal, psychological, or professional advice. Consult qualified professionals for decisions about your health, disability claims, or legal matters.

5. Community Conduct

When using community features, you agree to uphold a safe, respectful, trauma-informed space. Prohibited conduct includes:

Harassment, hate speech, or discrimination of any kind
Sharing another person’s personal information without consent
Threats, violence, or incitement to harm
Spam, scams, or commercial solicitation unrelated to the community’s mission
Impersonation or misrepresentation

We may remove content or restrict access that violates these standards, per our Community Guidelines.

6. Intellectual Property

The 3mpwrApp name, logo, and codebase are owned by 3mpwrApp or its licensors
You retain full ownership of content you create and share
By submitting content to community features, you grant us a non-exclusive, royalty-free license to display that content within the Service
Open-source components are governed by their respective licenses

7. Third-Party Services

The Service may integrate with third-party providers you choose to connect:

Cloud storage (BYOC): Google Drive, iCloud, Dropbox, OneDrive, WebDAV, Nextcloud, AWS S3, or others you select
Authentication: Firebase (email, Google, Apple sign-in) when account features are enabled
Content APIs: YouTube, Advocate Directory (public metadata only)
Push notifications: Expo Notifications

Your use of connected third-party services is subject to those providers’ terms. We do not control and are not responsible for third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure
We are not responsible for data loss resulting from device failure, user error, or third-party services
Accessibility features are provided to assist but do not guarantee specific outcomes

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3MPWRAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability, where permitted, shall not exceed the amount you paid for the Service (which is free).

10. Indemnification

You agree to indemnify and hold harmless 3mpwrApp and its contributors from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

You may stop using the Service at any time and delete your data. We may suspend or terminate access for violations of these Terms or applicable law, with notice where practicable.

12. Changes to These Terms

We may update these Terms to reflect changes in the Service, law, or user feedback. Updated Terms will show a new “Last Updated” date. Material changes will be communicated within the app or via the website.
